1. Who provides the service

The services and websites covered by these terms are provided by David García Martínez, a self-employed professional with Spanish tax ID (NIF) 48637127Q, address Plaza de las Flores, 2, 2.º E, 30820 Alcantarilla, Murcia (España). Contact: hola@soydavid.es · +34 649 517 104. Here I refer to myself as "I" or "the provider" and to you as "the client" or "the user".

2. Scope and acceptance

These terms govern: (A) use of the website soydavid.es; (B) professional services of SEO, GEO, AI automation, development and training consulting; and (C) use of the client panel panel.soydavid.es.

Browsing the website implies accepting part A. Accepting a proposal or quote, in writing or by email, implies accepting part B. Signing in to the panel with the credentials provided implies accepting part C. A signed contract or proposal with specific conditions prevails over these terms where they conflict.

My services are aimed at businesses, freelancers and professionals. If you contract as a consumer, the rights granted to you by consumer law (in particular Spanish Royal Legislative Decree 1/2007) also apply and take precedence.

Part A · The website

3. Use

The website is informational and free to use. You agree to use it lawfully and in good faith, and not to damage or overload it, access non-public areas or introduce malicious code.

4. Content and intellectual property

The texts, design, logo and code are mine unless stated otherwise. You may quote and link to them citing the source, but not copy them in full or exploit them commercially without written permission. Company names and trademarks mentioned belong to their owners and are used descriptively only.

5. Indicative information

What I publish about SEO, GEO or AI is general information based on my experience. It does not replace an analysis of your specific case and is not a binding offer.

6. Links

The site links to my own (such as iaquetrabaja.com) and third-party websites. I am not responsible for third-party content or policies.

Part B · Professional services

7. Services

Consulting and execution of SEO (technical, content, ecommerce and programmatic SEO), GEO (optimisation for AI search engines and assistants), process automation and AI integration (agents, chatbots, n8n or Make workflows, scripts and custom development) and training. The scope of each engagement is the one set out in the accepted proposal.

8. Proposal, price and payment

  • Before starting you receive a written proposal with scope, deliverables, indicative timelines and a fixed price or applicable rate. There are no published rates.
  • Unless stated otherwise, prices exclude VAT and other applicable taxes.
  • Recurring services are invoiced in advance per period; fixed projects according to the milestones in the proposal.
  • Payment is by bank transfer or another agreed method within the term on the invoice. Late payment allows the service to be suspended after notice and accrues the interest set by Spanish Law 3/2004 on late payment when the client is a business.
  • Costs of third-party tools or services needed for the project (AI API usage, licences, domains, hosting) are borne by the client unless included in the proposal. Whenever possible, those accounts are created in the client's name.

9. What I need from you

Timely information and agreed access (for example read access to Search Console or Analytics, the website or the tools to connect), reasonable review times for deliverables, and accurate information you are entitled to share. Delays caused by a lack of this cooperation move the timelines.

10. Results: what is and is not promised

I commit to working with professional diligence and following industry good practice. But nobody controls Google, Bing or AI models. Therefore:

  • I do not guarantee specific rankings, that an AI assistant will cite or recommend your brand, or a given level of traffic, sales or savings. My obligations are best-efforts obligations, except for the specific deliverables agreed.
  • Estimates of hours saved or impact are estimates, not promises.

11. Changes I apply to your website or systems

When the engagement includes applying changes, I try to take a prior backup and make changes reversible. The client remains responsible for keeping their own backups. I am not liable for losses caused by changes made by third parties, by the client or by failures of their platform providers.

12. Ownership of deliverables

Once paid, the client owns the deliverables made specifically for them (reports, content, configurations, automation workflows and code developed for their project), with documentation. I retain ownership of my pre-existing tools, templates, libraries and know-how, and grant the client a non-exclusive licence to the extent needed to use the deliverables. I may mention that we have worked together as a reference, without confidential details, unless you ask me not to.

13. Confidentiality and data

I treat all non-public information about your business as confidential, during and after the service. Where I process personal data on your behalf, we sign a data processing agreement under Article 28 GDPR. See the privacy policy.

14. Term and cancellation

Fixed projects end on delivery. Recurring services can be cancelled by either party with 15 days' notice before the next period, unless the proposal sets a different commitment. On termination, I hand over what is yours and remove my access to your systems.

15. Liability

My liability for any claim arising from a service is limited to the amount actually paid for that service in the twelve months before the event giving rise to it, except in cases of wilful misconduct or gross negligence. I am not liable for loss of profit, loss of business or indirect damage. This limitation does not apply where the law does not allow it, in particular towards consumers.

Part C · The client panel

16. What it is

panel.soydavid.es is a private tool I provide to clients as part of the service to view their project reports (Google rankings, traffic, visibility in AI search engines and technical health) and leave questions. It is not sold separately.

17. Access and accounts

  • I create accounts for the people the client designates. Each user must keep their password safe and not share it; it can be changed under "Mi cuenta" (My account).
  • If you suspect unauthorised access, tell me as soon as possible so I can block the account and issue a new password.
  • I may suspend an account in case of misuse, security risk or when the service ends.

18. Connecting Google

To show Google Analytics and Google Search Console data, the owner of those properties may authorise the panel, through Google's consent screen, with read-only scopes (analytics.readonly and webmasters.readonly). By doing so you confirm you are entitled to grant that access. The data is used only for your report, as described in the Google user data section of the privacy policy, in accordance with the Google API Services User Data Policy, including its Limited Use requirements. You can revoke access at any time at myaccount.google.com/permissions.

19. Acceptable use

You may not attempt to access other clients' projects, send automated bulk requests to the panel, circumvent its security or use its reports for unlawful purposes. Reports are for the client's internal use and may be shared with their team and collaborators.

20. Availability

I try to keep the panel available and up to date, but there may be interruptions for maintenance, failures or changes in Google's or other providers' APIs, and some data may arrive late or incomplete. There is no service level agreement unless agreed in writing. Panel data is indicative; your own Google accounts remain the reference source.

21. End of access

When the service ends, the account is deactivated and the Google authorisation and project data are deleted within the periods set in the privacy policy. If you want to keep a report, download it or ask me for it beforehand.

General provisions

22. Force majeure

Neither party is liable for failures caused by events beyond its reasonable control.

23. Changes to these terms

I may update these terms. The version applicable to each service is the one in force when the proposal was accepted; relevant changes affecting ongoing services or the panel will be notified to clients in advance.

24. Severability

If any clause is held invalid, the rest remains in force.

25. Governing law and jurisdiction

These terms are governed by Spanish law. The parties submit to the courts of Murcia (Spain), unless consumer law provides a different venue in favour of the consumer. Before that, I always suggest trying to sort it out by talking: hola@soydavid.es.
